These Website Terms and Conditions (“Terms”) govern your access to and use of our websites, portals, software, APIs, communications systems, mobile experiences, and related services.

By accessing, browsing, registering for, purchasing, subscribing to, or otherwise using the Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must discontinue use of the Platform.

4. No Legal, Financial, Regulatory, or Credit Advice

TrackStar AI is a technology company and does not provide:

  • Legal advice

  • Financial advice

  • Tax advice

  • Credit counseling

  • Regulatory guidance

  • Consumer reporting agency services

  • Guaranteed dispute services

Nothing on the Platform should be interpreted as professional advice.

Users remain solely responsible for:

  • Reviewing all submissions and communications;

  • Verifying all information;

  • Consulting qualified professionals where appropriate;

  • Determining legal or regulatory obligations.

TrackStar AI does not guarantee:

  • Credit score increases;

  • Deletion of information from credit reports;

  • Loan approvals;

  • Business growth;

  • Consumer dispute outcomes;

  • Financial improvement outcomes;

  • Regulatory compliance outcomes.


5. Artificial Intelligence and Automated Systems

The Platform may utilize artificial intelligence, machine learning, automation systems, predictive technologies, and algorithmic processing.

These systems may assist with:

  • Consumer engagement;

  • Workflow automation;

  • Content generation;

  • Communications;

  • Reporting and analytics;

  • Fraud monitoring;

  • Recommendations;

  • Document preparation assistance;

  • Operational support.

AI-generated or automated outputs may contain inaccuracies, incomplete information, outdated information, or errors.

Users remain solely responsible for reviewing, approving, validating, and monitoring all outputs before relying upon them.

TrackStar AI disclaims liability arising from reliance on automated or AI-assisted outputs.


6. Account Registration and Security

Access to certain features may require registration.

You agree to:

  • Maintain accurate account information;

  • Keep login credentials secure and confidential;

  • Restrict unauthorized account access;

  • Promptly notify us of suspected unauthorized use;

  • Accept responsibility for activities occurring under your account.

TrackStar AI reserves the right to suspend, restrict, or terminate accounts where:

  • Fraud is suspected;

  • Security concerns arise;

  • Abuse occurs;

  • Regulatory risks are identified;

  • These Terms are violated;

  • Payment obligations remain unresolved.


7. White-Label and Reseller Relationships

Certain portions of the Platform may be operated by or through independent resellers, enterprise clients, or Business Clients.

Business Clients and resellers are solely responsible for:

  • Their own customer relationships;

  • Consumer contracts and disclosures;

  • Customer support obligations;

  • Marketing and advertising compliance;

  • Consumer consent collection;

  • Regulatory and licensing compliance;

  • Financial services compliance obligations;

  • Consumer dispute obligations.

TrackStar AI acts primarily as a technology platform provider unless expressly stated otherwise in writing.

If you are an end user working with a reseller or Business Client, certain support, deletion, correction, cancellation, or account requests may need to be directed to that reseller or Business Client.


8. Acceptable Use

You agree not to:

  • Violate any law or regulation;

  • Upload unlawful or harmful material;

  • Engage in fraud or deceptive conduct;

  • Misrepresent products or services;

  • Send spam or unauthorized communications;

  • Circumvent security measures;

  • Reverse engineer or exploit the Platform;

  • Interfere with platform operations;

  • Upload malware or malicious code;

  • Infringe intellectual property rights;

  • Use the Platform to harass, abuse, or harm others;

  • Violate TCPA, CAN-SPAM, GDPR, FCRA, GLBA, or similar laws.

TrackStar AI reserves the right to investigate suspected misuse and take appropriate action.


9. Communications Consent

By using the Platform and providing contact information, you consent to receive:

  • Emails;

  • SMS or text messages;

  • Push notifications;

  • Telephone calls;

  • Artificial or prerecorded voice communications;

  • Service and account notifications.

These communications may relate to:

  • Account management;

  • Customer support;

  • Security alerts;

  • Scheduling reminders;

  • Product updates;

  • Marketing communications;

  • Operational notifications.

You are responsible for obtaining all legally required consents before using Platform communication features with third parties.

Message and data rates may apply.

Users may opt out of promotional communications through available unsubscribe methods.


10. Monitoring and Abuse Prevention

To protect the integrity and security of the Platform, TrackStar AI may monitor:

  • System activity;

  • Platform logs;

  • Messaging activity;

  • Uploaded files;

  • Usage patterns;

  • Security events;

  • Administrative activity.

Monitoring may occur for:

  • Fraud prevention;

  • Security enforcement;

  • Regulatory compliance;

  • Abuse detection;

  • Platform maintenance;

  • Service optimization.

By using the Platform, you acknowledge and consent to such monitoring where permitted by applicable law.


11. User Content

Users may upload, transmit, submit, or store information, documents, communications, or other content (“User Content”) through the Platform.

You retain ownership of User Content; however, you grant TrackStar AI a non-exclusive, worldwide, royalty-free license to host, process, store, transmit, display, backup, analyze, and use User Content solely for purposes related to operating and improving the Platform.

You represent and warrant that:

  • You own or have rights to the User Content;

  • The User Content does not violate applicable laws;

  • The User Content does not infringe third-party rights.

TrackStar AI reserves the right to remove or restrict User Content at its discretion.


12. Intellectual Property Rights

All Platform technology, software, source code, interfaces, systems, workflows, branding, graphics, AI systems, documentation, and related materials are owned by or licensed to TrackStar AI.

Except as expressly authorized, users may not:

  • Copy;

  • Modify;

  • Republish;

  • Reverse engineer;

  • Scrape;

  • Distribute;

  • Resell;

  • Create derivative works;

  • Exploit Platform technology.

Unauthorized use may result in immediate suspension, termination, and legal action.

TrackStar AI reserves the right to pursue injunctive relief and all available remedies for misuse of proprietary technology or intellectual property.


13. Third-Party Services and Integrations

The Platform may integrate with or rely upon third-party providers, including:

  • Cloud hosting providers;

  • Payment processors;

  • Communication providers;

  • CRM providers;

  • Analytics providers;

  • Scheduling providers;

  • Identity verification providers;

  • Financial data providers.

TrackStar AI is not responsible for third-party systems, services, uptime, security practices, or content.

Use of third-party services is governed by the applicable third-party terms and policies.


14. Data Privacy and Security

Use of the Platform is also governed by our Privacy Policy.

The Platform may process sensitive information including:

  • Social Security numbers;

15. Platform Availability

TrackStar AI does not guarantee uninterrupted or error-free operation of the Platform.

The Platform may experience:

  • Maintenance interruptions;

  • Security incidents;

  • Third-party outages;

  • Infrastructure failures.

TrackStar AI reserves the right to modify or discontinue functionality at any time.


16. Compliance Responsibilities

Users are solely responsible for ensuring that their use of the Platform complies with all applicable laws, regulations, and industry requirements.

TrackStar AI does not guarantee that use of the Platform satisfies:

  • State licensing laws;

  • Consumer protection requirements;

  • Financial services regulations;

  • Advertising regulations;

  • Privacy laws;

  • Credit services organization laws;

  • Communication laws.


17. Disclaimer of Warranties

THE PLATFORM AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.”

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRACKSTAR AI DISCLAIMS ALL WARRANTIES, INCLUDING WARRANTIES OF:

  • MERCHANTABILITY;

  • FITNESS FOR A PARTICULAR PURPOSE;

  • NON-INFRINGEMENT;

  • ACCURACY;

  • RELIABILITY;

  • SECURITY;

  • PERFORMANCE;

  • AVAILABILITY.

TrackStar AI does not warrant that:

  • The Platform will operate without interruption;

  • Errors will be corrected;

  • Data will always be accurate or complete;

  • AI-generated outputs will be reliable;

  • Services will meet user expectations.


18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRACKSTAR AI SHALL NOT BE LIABLE FOR:

  • INDIRECT DAMAGES;

  • INCIDENTAL DAMAGES;

  • CONSEQUENTIAL DAMAGES;

  • SPECIAL DAMAGES;

  • LOST PROFITS;

  • LOST REVENUE;

  • LOST DATA;

  • BUSINESS INTERRUPTION;

  • REPUTATIONAL HARM;

  • REGULATORY PENALTIES;

  • THIRD-PARTY CLAIMS.

IN NO EVENT SHALL TRACKSTAR AI’S TOTAL LIABILITY EXCEED THE AMOUNT PAID TO TRACKSTAR AI BY THE APPLICABLE USER DURING THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Some jurisdictions may not permit certain limitations, so portions of this section may not apply.


19. Indemnification

You agree to defend, indemnify, and hold harmless TrackStar AI and its affiliates, officers, directors, employees, contractors, licensors, and partners from any claims, liabilities, damages, losses, costs, or expenses arising from:

  • Your use of the Platform;

  • Your User Content;

  • Violations of these Terms;

  • Violations of applicable law;

  • Messaging or marketing activity;

  • Consumer disputes;

  • Regulatory investigations;

  • Violations of third-party rights.


20. Arbitration and Class Action Waiver

To the fullest extent permitted by law, disputes arising from or relating to the Platform or these Terms shall be resolved through binding individual arbitration.

Users waive the right to:

  • Participate in class actions;

  • Participate in representative proceedings;

  • Participate in consolidated proceedings;

  • Seek jury trials.

Nothing in this section prevents either party from seeking temporary injunctive relief where appropriate.


21. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

TrackStar AI maintains operational activities in Arizona.

Subject to applicable arbitration provisions, venue for disputes shall be determined by TrackStar AI.


22. Termination

TrackStar AI may suspend or terminate access to the Platform at any time, with or without notice, where:

  • These Terms are violated;

  • Fraudulent activity is suspected;

  • Security risks arise;

  • Regulatory concerns exist;

  • Abuse occurs;

  • Payment obligations remain unresolved.

Upon termination:

  • Access rights immediately cease;

  • Certain information may remain retained as permitted by law;

  • Surviving obligations remain enforceable.


23. Force Majeure

TrackStar AI shall not be liable for delays or failures caused by events beyond reasonable control, including:

  • Natural disasters;

  • Cyberattacks;

  • Internet outages;

  • Infrastructure failures;

  • Labor disputes;

  • Government actions;

  • Third-party service interruptions;

  • Power outages.


24. Electronic Signatures and Records

You consent to the use of:

  • Electronic records;

  • Electronic communications;

  • Electronic signatures;

  • Digital acknowledgments.

Electronic records shall have the same force and effect as physical documents where permitted by law.


25. Changes to These Terms

TrackStar AI may update or modify these Terms at any time.

Updated Terms become effective upon posting unless otherwise required by law.

Continued use of the Platform following updates constitutes acceptance of the revised Terms.


26. Severability

If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect.


27. Entire Agreement

These Terms, together with our Privacy Policy and any applicable supplemental agreements, constitute the complete agreement between users and TrackStar AI regarding the Platform.
